Anti-social behaviour case review

The Anti Social Behaviour, Crime and Policing Act 2014 introduced the Anti-social Behaviour Case Review. 

The Anti-Social Behaviour (ASB) Case Review is a process which allows member of the public to ask their Community Safety Partnership to review responses to incidents of anti-social behaviour.  

The case review has been introduced to help ensure that agencies are working together to resolve incidents of anti-social behaviour that are affecting residents’ quality of life. We will do this by appropriately sharing information between agencies, reviewing the actions that have been taken and use available resources to try and reach a solution and make recommendations that will hopefully prevent the situation from reoccurring.

The review process doesn't replace the existing complaints procedures of individual organisations, therefore if you're unhappy with the service you received or action taken by a particular organisation you can follow their official complaints procedure.

ASB Case Review threshold

The anti-social behaviour case review is there to encourage us, Essex Police and other relevant bodies to work together to deal with serious and persistent cases of ASB. It also helps us check whether any more actions are needed to deal with a problem.

You can ask for a review if:

  • you have complained to the Council, Essex Police or housing provider three times about separate incidents of anti-social behaviour within one month of the alleged behaviour
  • the application to use the ASB case review is made within six months of the report of the anti-social behaviour
  • each incident has been reported within one month of the incident taking place

The case review is not designed to replace existing anti-social behaviour reporting lines or for reporting crime, including hate crime, although these can be included in the number of incidents you have reported if you feel they were part of the anti-social behaviour.

Information you will be asked to provide

The ASB case review request form is very detailed and you will be asked to provide details of:

  • dates when you made a complaint about Anti-social Behaviour (ASB) or hate crime to the Council, the Police or your housing provider
  • who you reported the incident to
  • details of the anti-social behaviour incident you are reporting
  • incident or reference numbers you have been given
  • any other information about the incidents reported

ASB Case Review process

The relevant agencies involved in your case will review your application and you will be told whether your case meets the ASB review criteria.

If it doesn't meet the criteria, you may be given advice on what else you can do.

If it does meet the criteria, relevant agencies will carry out a panel review of your case and decide whether any further action is necessary. Our Community Safety Manager will make sure your request is heard at the next available Local Action Group which will act as the Review Panel for all ASB case reviews. This will be within one month and involve all agencies or partners that have been involved in your case. Those attending the meeting will look at what action has been taken in response to your reports of anti-social behaviour. Recommendations will be made to the relevant agencies regarding any future action that will need to be undertaken.

The legislation places a duty on a person who carries out public functions to have a regard to those recommendations. This means that they aren't obliged to carry out the recommendations, but that they should acknowledge them and may be challenged if they choose not to carry them out without good reason. The Community Safety Manager will write to you detailing:

  • the outcome of the case review
  • any recommendations made
  • the appeals process

You will receive this letter within ten working days of the meeting being. Should the review take longer, we will contact you to explain the delay.

If you're unhappy with the way the review was handled

You can appeal the decision and outcome of your ASB case review, you can request a secondary review be carried out by an independent panel. You must submit your appeal in writing within 21 days of receiving your outcome letter. 

The secondary review is the last step that can be taken in the process.
